A Charge of Resisting Arrest, What To Do?

The right criminal lawyer with over 25 years of experience, David Pflaum agressively defends a client who has been charged with a resisting arrest charge to get the best possible results.

One of the most important goals is to keep a client’s record clean.

Just because a person was arrested for a rime does not mean that he or she is guilty.  The accused has rights and remedies.

WHAT A DEDICATED CRIMINAL DEFENSE LAWYER DOES TO HELP BEFORE COURT

If the police think someone failed to follow their order or was resisting arrest, that person may be charged for a misdemeanor violation of Penal Code section 148(a).

In some instances, the police will charge the individual with a felony violation of Penal Code section 69, which is essentially an aggravated version of resisting arrest.

Initial Consultation. The first step is meeting with the client or the client’s relatives. Attorney Pflaum learns about the client’s employment, family, criminal history, support in the community, and military experience.

Once the defense attorney has all the information, he can determine the best strategy to get the right results.

WHAT THE DEFENSE ATTORNEY DOES DURING THE COURT PROCESS

Plea Bargain. Once the attorney has all the information about the case, the client’s background, arrest reports, witness statements, the evidence seized by the police and other important factors, he presents it to the prosecutor and judge to negotiate a plea bargain.

A plea bargain can eliminate or reduce the charges, avoid time in jail, reduce the fines, and minimize the punishment.

If the client and the defense attorney do not accept the plea bargain offer, then the case goes to trial.

Jury Trial. For cases that cannot be, or should not be, settled by way of a plea bargain, attorney Pflaum is ready to go to jury trial and win the case.

WHY RESISTING ARREST?

The police are trained to “take and maintain control” of an individual being detained or investigated at all times for their and others’ safety.

However, it is not at all uncommon for a police officer to cross the line between good police work and an abuse of authority.

Sometimes the police, during a detention or investigation, actually lose control of the situation and become very aggressive even though the individual did nothing wrong.

SOME INTERESTING ASPECTS OF THIS TYPE OF ARREST

Sometimes a police officer loses control of a situation, overreacts or becomes extremely aggressive.

It is not uncommon for the police officer to attempt to “cover up” their own bad behavior by claiming the individual resisted arrest or failed to follow a lawful order in violation of Penal Code section 148(a), or the felony violation of PC 69.

DEFENSES

This depends upon the facts of the arrest, the background of the arresting police officer, video of the arrest, and witness statements. Often times there are conflicting reports that prove the police officer is not telling the truth.

Recent Court Victories *

1.  Client charged with felony assault, spousal abuse and criminal threats. Bail was set at $200,000. 
Attorney Pflaum convinced the judge to reduce bail to $20,000 and to allow the client to return home. 
The case was hard fought. 
The results: dismissal of all charges but for one count of misdemeanor battery.

2.  Client charged with grand theft.  Mr. Pflaum presented substantial favorable information about the client to the district attorney. 

Charge reduced to a misdemeanor disturbing the peace.

3.  Client filed a request for a temporary restraining order (TRO) due to being humiliated and harassed by the respondent. 

Attorney Pflaum resolved the case.

Our client received attorney fees from the respondent, a written apology and an extension of the TRO.

4.  Client was charged with DUI of prescription drugs. 

The DUI was dismissed. Drivers license not suspended.

5.  Client charged with a hit and run.  We arranged to make payment of damages to the victim. 

Case dismissed.
