The following are results that occurred in cases where the clients had immigration issues such as deportation related to their original charges, but which ultimately were resolved with no immigration consequences.*
1. The client was charged with aggravated felony involving abuse of a minor for purposes of the Immigration Nationality Act for which deportation would be mandatory if convicted. Over a period of six months, we were able to collect and present many mitigating factors which including client’s lack of record, ties to the community, and employment history helped us get the original charge dismissed. Defendant plead guilty to a different charge with no immigration consequences. (People v. A.T.)
2. The client was charged with controlled substance offense rendering him deportable. We examined the police report and contested the legality of the detention of the accused. As a result, the accused entered a plea to a non-controlled substance offense and avoided immigration consequences. (People v. I.M.).
3. The client was charged with two counts of violation of Penal Code section 242, Battery. We investigated the allegations of the complaining witnesses, including their demand for in excess of $100,000 for their injuries. The complaining witnesses also testified in court during a related civil hearing. We were able to show that the complaining witnesses were not believable. The original charges were dismissed There were no immigration consequences. (People v. L.G.)
